论婚姻家庭法立法价值取向的多元化——以法社会学为视角 熊金才 【期刊名称】《中华女子学院学报》 【年(卷),期】2015(0)6 【摘 要】婚姻家庭法的立法价值取向与社会类型和社会结构密切相关,随社会类型演进、社会结构分化以及文化的多样化而不断由单一趋向多元.从社会类型看,婚姻家庭法立法价值取向随人类社会由传统至现代的转型逐步由封闭走向开放、由身份走向契约、由义务本位趋向权利本位,实质上是婚姻当事人个人价值不断被法律认可的过程. 从结构差异性看, 婚姻家庭法的立法价值取向存在不同文化、不同地理区域以及不同社会群体间的差异,是不同社会分层个人生活方式选择差异的结果. 婚姻家庭法立法价值取向与社会类型和社会结构的互动关系不仅可以解释相应制度,亦可揭示其发展趋势,进而提升相关立法的社会适应性.%The legislative value orientation of marriage and family law is closely related to social types and social structures. It develops with the evolution of social types, the differentiation of social structure and the diversity of culture. From the perspective of social types, the legislative value orientation of marriage and family law tends to be more open, more contracts and rights featured with the development of the society, which is in essence a process of legal recognition of personal value. From the perspective of social structure, the legislative value orientation of marriage and family law differs with stratification, culture and social governance model.
